Wills
If you have yet to make a will then you will be unable to guarantee that those you intend to benefit from your estate will do so. We provide a comprehensive Wills service ensuring that all eventualities which may affect your wishes in the future are taken into account and that your will is kept securely at our offices so that your wishes will be preserved. When drafting we would also advise on any potential Inheritance Tax implications of your Will and estate generally.
All too often the wishes of those who depart us are not properly recorded and those that were intended to benefit from their estate are left with nothing.
The value of the peace of mind that comes in knowing that those you care about will be provided for after your death cannot be overstated. For this reason it is important to consider making a Will whatever age you are as this is the only way you can ensure that your wishes will be followed with regards to the disposition of your estate upon death.
Probate
Upon the death of a relative or loved one there are many legal formalities that must be complied with in connection with the administration of the deceased’s estate. For many the burden of fulfilling these legal obligations during the time that they are bereaved can be unduly stressful and some of the formalities required can seem insensitive to those involved.
For this reason we offer a caring and conscientious probate service to assist you in managing the estate of your loved one right from the outset. Some of the areas in which we offer our assistance and advice include:
Identifying the person responsible for administering the estate as the personal representative of the deceased
Establishing the extent of the estate
Assessing the estates inheritance tax liability
Applying for a grant of probate/administration in order to allow the personal representative to deal with the estate
Gathering in the deceased’s assets
Paying the deceased’s debts and addressing his liabilities; and
Distributing his estate according to their Will, or law.
Powers of Attorney and Deputyship
When someone loses capacity to deal in their own affairs, this can cause much stress to those that are left to take on the administration of another person’s affairs. We would always advise that everyone creates a Lasting Power of Attorney, appointing people to act should they lose capacity. It may be the case that this is never required in the future, but at least having it can provide peace of mind.
If you have a family member who has lost capacity and does not already have a Power of Attorney in place, the only way you will be able to act would be by way of becoming a deputy. This involves making an application to the Court of Protection for deputyship.
